John Rust, a candidate who was denied access to Indiana’s GOP primary ballot earlier this year, is taking his case to the Supreme Court of the United States. Rust filed a 217-page petition arguing that Indiana’s ballot access laws are overly restrictive and do not serve the interests of voters. His appeal comes after the Indiana Election Division blocked his candidacy based on a state law that requires a candidate’s last two primary votes to match the party they wish to represent.
Rust’s legal counsel expects that oral arguments, if the Supreme Court accepts the case, will not be heard until early next year. Rust has been fighting for ballot access for constitutionally qualified Hoosiers and believes that the Indiana Supreme Court’s decision stifles democracy by limiting choices for voters in primaries.
Rust’s petition also challenges Indiana’s requirement for U.S. Senate hopefuls to obtain 4,500 signatures in support of their candidacy. The petitioning requirement, along with the party affiliation statute, creates barriers for potential candidates and limits the democratic process.
Although Rust’s campaign for the U.S. Senate was halted due to ballot access issues, he remains determined to fight for the rights of Hoosiers to freely associate with their chosen political party. Despite the obstacles, Rust has closed his Senate campaign but will continue to seek justice through the legal system. The Supreme Court’s decision on whether to take up the case is expected this fall.
