Manhattan prosecutors will defer to the judge on former President Donald Trump’s request to delay his sentencing on falsifying business records charges until after the election. The sentencing hearing is set for Sept. 18, but Trump is seeking to have his conviction overturned based on a Supreme Court ruling on presidential immunity. Prosecutors agree to allow time for the judge to rule on Trump’s motion while trying to avoid unnecessary delays in the sentencing process. Trump’s lawyers argue that the existing timeline does not allow them enough time to pursue an appeal before sentencing if the motion to dismiss is rejected. Trump was convicted on charges related to a hush money payment to Stormy Daniels during the 2016 presidential campaign, making him the first former president to be convicted of a crime. His lawyers had requested the postponement of the sentencing to present arguments based on the Supreme Court’s July 1 decision on presidential immunity. If the judge approves the postponement, it would be a significant win for Trump, who is also facing other criminal trials this year.
