An Indiana judge has made a landmark ruling that a state prison must provide transgender surgery for an inmate who is serving time for killing a baby. The decision comes after the inmate, who was born male but identifies as female, sued the prison for denying her the surgery that she argued was necessary to treat her gender dysphoria.
The inmate’s lawyer hailed the ruling as a major victory for transgender rights and healthcare in the prison system. It is believed to be the first time that a judge has ordered a prison to provide gender confirmation surgery for an inmate in the United States.
The inmate, who goes by the name Kathrine Nicole Jett, has been serving a 130-year sentence for the 2009 murder of a 23-month-old baby. Jett has been diagnosed with gender dysphoria, a condition where a person’s gender identity does not align with their assigned sex at birth.
The judge’s ruling stated that denying Jett the surgery would constitute “cruel and unusual punishment” in violation of the Eighth Amendment of the U.S. Constitution. The judge also emphasized the importance of providing adequate medical care to transgender inmates and noted that gender confirmation surgery has been recognized as a medically necessary treatment by several medical organizations.
