Indiana Attorney General Urges Reconsideration of High-Potency THC Bill

INDIANAPOLIS (WISH) — Attorney General Todd Rokita is calling on Indiana lawmakers to rethink Senate Bill 478, which aims to reclassify high-potency THC products as hemp. In a letter to the Indiana General Assembly dated April 21, 2025, Rokita expressed concerns that the legislation could lead to an unregulated cannabis market, potentially undermining existing state marijuana laws and posing significant public safety threats.

Rokita’s comments come as the bill is being deliberated by a conference committee during the final stages of the 2025 legislative session. He emphasized, “This isn’t about taking away your grandma’s CBD oil – it’s about protecting Hoosiers from high-potency THC products that mirror and often exceed the intoxicating effects of marijuana.”

The proposed legislation permits the sale of “craft hemp flower products,” which could include edibles containing up to 100 milligrams of THC per serving and a staggering 3,600 milligrams per package. According to Rokita, these levels surpass the limits set in many states where recreational marijuana is legal, where serving sizes are typically capped at 10 mg and packages at 100 mg.

Rokita urged lawmakers to amend the bill to classify any product with THC levels exceeding 0.3% by dry weight as marijuana under state law, including synthetic THC. He argues that this change would close existing loopholes and provide necessary clarity for law enforcement agencies engaged in regulatory oversight.

As lawmakers consider the implications of this legislation, Rokita’s warning about the potential consequences for public safety and regulatory integrity emphasizes the need for careful deliberation in shaping Indiana’s cannabis policy.
