Carmel Clay Schools Board Revises Policy on Student Interviews by Law Enforcement
CARMEL, Ind. (WISH) — In a significant move aimed at enhancing student protection, the Carmel Clay Schools Board is reviewing updates to its policy governing how and when law enforcement and the Indiana Department of Child Services (DCS) can interview students on school grounds. This was discussed in their latest meeting on Monday night.
The policy, which has not been revised since 2008, includes new provisions that prohibit interviewing students by government agencies on school property, with exceptions only in exigent circumstances. Under the proposed changes, DCS agents would only be able to interview students without parental consent if they present credentials and a written statement indicating consent, a court order, or exigent circumstances as defined by Indiana law. Importantly, a principal or designated staff member must be present during the interviews to ensure proper oversight without interference.
Carmel Clay School Board member Kristina Wheeler emphasized the necessity of these revisions to protect students in sensitive situations. "It would be appropriate not to notify the parent," she stated, referring to cases where the parent may be implicated in abuse or neglect.
Additionally, the revised policy stipulates that school officials must promptly inform parents or guardians if their child is taken from the school. This change replaces previous language that only required notification before the student’s usual return home.
The updated policy is currently in its first reading phase. The Carmel Clay Schools Board welcomes feedback and concerns from the community as they move forward with these important changes aimed at safeguarding students’ well-being.
